Legal terms and conditions for using Link Nova's AI voice automation services

These terms are effective immediately upon your use of Link Nova services.

1. Introduction and Acceptance

Welcome to Link Nova. These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "User", or "you") and Link Nova Pty Ltd ("Link Nova", "we", "us", or "our") regarding your use of our AI voice automation platform and related services.

By accessing, using, or subscribing to Link Nova's services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.

Important: These Terms may be updated from time to time. Continued use of our services after changes constitutes acceptance of the modified Terms.

2. Service Description

2.1 AI Voice Automation Platform

Link Nova provides an AI-powered voice automation platform that enables businesses to create, deploy, and manage intelligent voice agents for customer service, sales, and communication purposes. Our services include but are not limited to:

  • Automated inbound and outbound calling capabilities
  • Natural language processing and conversation management
  • CRM and third-party system integrations
  • Real-time analytics and reporting dashboards
  • Multi-language voice agent configuration
  • Call recording and transcription services

2.2 Service Availability

We strive to maintain 99.9% uptime for our services. However, we do not guarantee uninterrupted service and may perform scheduled maintenance that could temporarily affect service availability.

3. User Obligations and Responsibilities

3.1 Account Security

  • Maintain the confidentiality of your account credentials
  • Notify us immediately of any unauthorized account access
  • Ensure all account information is accurate and up-to-date
  • Accept responsibility for all activities under your account

3.2 Compliance Requirements

  • Comply with all applicable laws and regulations in your jurisdiction
  • Obtain necessary consent for call recordings and data processing
  • Respect do-not-call lists and privacy preferences
  • Ensure compliance with GDPR, POPIA, and other data protection laws
  • Maintain appropriate licenses for commercial calling activities

3.3 Prohibited Uses

You agree NOT to use Link Nova services for:

  • Harassment, spam, or unsolicited communications
  • Fraudulent, deceptive, or illegal activities
  • Sharing false, misleading, or defamatory information
  • Violating intellectual property rights
  • Circumventing security measures or system limitations
  • Emergency services or life-critical communications

4. Payment Terms and Billing

4.1 Subscription Fees

Subscription fees are based on your selected plan and usage tier. All fees are:

  • Charged in advance for the billing period
  • Non-refundable except as specified in our Refund Policy
  • Subject to applicable taxes and fees
  • Processed through our secure Paystack payment gateway

4.2 Usage-Based Charges

Additional charges may apply for usage exceeding your plan limits, including overage fees for call minutes, API requests, or premium features. All usage-based charges are calculated monthly and billed in arrears.

4.3 Payment Processing

Payments are processed securely through Paystack. By providing payment information, you authorize us to charge your selected payment method for all applicable fees. Failed payments may result in service suspension.

5. Data Privacy and Security

5.1 Data Collection and Use

We collect and process data necessary to provide our services, including call recordings, conversation transcripts, and usage analytics. Our data practices are governed by our Privacy Policy, which forms an integral part of these Terms.

5.2 Data Security

  • Industry-standard encryption for data in transit and at rest
  • Regular security audits and vulnerability assessments
  • Access controls and monitoring systems
  • Compliance with SOC 2 and ISO 27001 standards

5.3 Data Retention

Call recordings and transcripts are retained for the duration specified in your subscription plan, typically 90 days for standard plans and up to 2 years for enterprise plans. Data is securely deleted after the retention period expires.

6. Intellectual Property Rights

6.1 Link Nova's IP Rights

Link Nova retains all rights, title, and interest in our platform, including software, algorithms, user interfaces, documentation, and related intellectual property. These Terms grant you a limited, non-exclusive license to use our services.

6.2 Customer Data Rights

You retain ownership of all data, content, and information you provide to or generate through our services. You grant Link Nova a limited license to process this data solely for the purpose of providing our services.

6.3 Voice and Brand Usage

Custom voice models and brand elements created for your account remain your property. However, Link Nova may use anonymized and aggregated data for service improvement and machine learning purposes.

7. Service Level Agreement

7.1 Uptime Guarantee

  • • 99.9% uptime for Starter and Growth plans
  • • 99.95% uptime for Enterprise plans
  • • Service credits for downtime exceeding SLA thresholds
  • • Scheduled maintenance excluded from uptime calculations

7.2 Support Response Times

  • Starter Plan: 48-hour response time
  • Growth Plan: 24-hour response time
  • Enterprise Plan: 4-hour response time with dedicated support
  • Critical issues: Escalated response within 2 hours for all plans

8. Limitation of Liability

Please read this section carefully as it limits Link Nova's liability to you.

8.1 Service Disclaimer: Link Nova provides services "as is" without warranties of any kind. We do not guarantee that our services will meet your specific requirements or be error-free.

8.2 Liability Limitation: Link Nova's total liability for any claims arising from these Terms or your use of our services shall not exceed the amount you paid to Link Nova in the 12 months preceding the claim.

8.3 Excluded Damages: Link Nova shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption.

8.4 Third-Party Services: We are not responsible for the performance, availability, or security of third-party services or integrations you choose to use with our platform.

9. Termination

9.1 Termination by Customer

You may terminate your subscription at any time through your account dashboard or by contacting our support team. Termination takes effect at the end of your current billing period.

9.2 Termination by Link Nova

We may suspend or terminate your account if you:

  • Violate these Terms or our Acceptable Use Policy
  • Fail to pay fees when due
  • Engage in fraudulent or illegal activities
  • Pose a security risk to our platform or other users

9.3 Effect of Termination

Upon termination, your access to services will cease, and your data will be retained according to our data retention policy. You remain responsible for all charges incurred before termination.

10. Governing Law and Dispute Resolution

10.1 Governing Law: These Terms are governed by the laws of South Africa, without regard to conflict of law principles.

10.2 Jurisdiction: Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Cape Town, South Africa.

10.3 Dispute Resolution: Before pursuing legal action, parties agree to attempt resolution through good faith negotiations for 30 days.

11. General Provisions

11.1 Entire Agreement: These Terms, together with our Privacy Policy and other referenced policies, constitute the entire agreement between you and Link Nova.

11.2 Modifications: We may modify these Terms at any time. Material changes will be communicated via email 30 days before taking effect.

11.3 Severability: If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

11.4 Assignment: You may not assign these Terms without our written consent. Link Nova may assign these Terms in connection with a merger, acquisition, or sale of assets.
